Terms of sale of Bagafrance

Bagafrance is a goods and passengers transport company. As such, Bagafrance is officiallly registered and recognized as a transport company at both regional and national level.

1/ Transport of luggage, bicycles and other goods.

1.1. Transport of luggage, bicycles and other goods.

Bagafrance carries out any transport or transfer according to a public transportation contract. This activity is conducted according to the following  regulations:

- The French « Internal Transportation Orientation Law - Loi d’Orientation pour le Transport Intérieur » (LOTI), which is following the european directives related to tranportaiton activities and which offers guarantees to the company as well as to the customer.

- The French « Civil Code - Code Civil » (art.1782 à 1786), 

- The French « Code of Commerce - Code du commerce » (art.L 132-8/9 art.L 133-1 à L 133-7) and the related decrees.


1.2. The French « Internal Transportation Orientation Law - Loi d’Orientation pour le Transport Intérieur » (LOTI)

- It defines the following responsibilities:

- The loading operations as well as the stowage inside the vehicles and the unloading operations are under the responsibilities of the transport company.

- The packaging of the transported goods is under the responsibility of the customer who orders the transport (therefore, every piece of luggage is to be in good condition and of a quality which is good enough to efficiently protect the belongings inside).

1.3. Area of operation of Bagafrance

This area is the one where the selected rates shown on the website www.bagafrance.com apply (see the page "Luggage, bicycles and persons"). Every booking for transfer is automatically validated or not according to the following limits:

- Along a 5 km wide corridor on each side of the "Cycling the Loire" itineraries as defined on the website "Cycling the Loire" or "La Loire à Vélo" at http://www.cycling-loire.com or  http://www.loireavelo.fr, between Orléans and Angers, these two cities included.

- The areas of Chambord, Chenonceaux, Azay-le-Rideau, Chinon and Fontevraud are included in the area of operations along a 5 km wide corridor on each side of the "Cycling the Loire" itineraries as defined on the website "Cycling the Loire" or "La Loire à Vélo" at http://www.cycling-loire.com or  http://www.loireavelo.fr.

- The itineraries Chambord - Cheverny and Cheverny - Chitenay - Candé-sur-Beuvron are also included according to the same rule. 

Nevertheless, Bagafrance is able to operate other areas, depending on the availability of the company's vehicles and according to special rates.

1.4. The Commitments of Bagafrance

Bagafrance guarantees the luggage delivery before 6:00 pm for every transfer to the location as it is described on the transfer booking.

During the transport, the luggage and the others transported goods are permanently controlled until they are delivered. Two phone numbers are reachable for any question or request between 8:00 am and 8:00 pm:  +33 (0)7 76 35 64 43 or  +33 (0)7 86 38 41 27. 

1.5. Advice to the Bagafrance customers

Every piece of luggage is checked during the collection and should not weight more than 25 kilos. If a piece of luggage exceeds 25 kilos and has not been declared as such prior to collection, Bagafrance requests from the customer an extra fee. If the customer refuses to pay the extra fee, the piece of luggage is not transfered. 

The customer commits himself in informing the staff of the various booked accommodations on the role of Bagafrance regarding the collection and delivery of the luggage.

The luggage must not contain any hazardous or flamable material of any type (alcool, gaz, gasoline) as well as any illegal substance and product (drug, including canabis) or valuables, medicines, weapon of any kind.

For practical reasons, in order to comply with the French "Vigipirate" anti-terror regulations, the luggage must be labelled as soon as collected for the first time. The word "BAGAFRANCE", the last name, the first name, and the mobile phone number are to be clearly identified on every piece of luggage

Every piece of luggage must be carrefully closed and locked, if possible.


For the bicycle transport (when the customer is not transported together with the bicycle), the bike must be identified according to the same principle. In addition, the bike must be prepared for the transport, all the accessories (helmet, lock, repair kit, road-book, GPS, etc..) and saddlebags must be put apart in separate bags

1.6. Booking Policy 

Bagafrance operates only when the transfers and/or the transport are booked at least 24 hours prior to the departure (i.e. before 9:00 am on the day before the first stage)

This booking must be registered and validated thanks to the reservation form which is on the Bagafrane website. For special requests, the booking is made by email at reservation@bagafrance.com or by phone.

1.7. Cancellation Policy

Any cancellation of a transfer must be done by email or by phone at least 24 hours prior to the departure (i.e. before 9:00 am the day before the planned transfer).
 
Any cancellation (cancellation of one, several or all daily transfers) which is made more than 24 hours prior to the departure is accepted by Bagafrance and is subject to a full reimbursement.
 
For any cancellation of a daily transfer which is made less than 24 hours prior to the departure (i.e after 9:00 am the day before), this daily transfer  is unfortunately not reimbursed by Bagafrance. 

1.8. Request for change Policy

Any requested change of the service (change of the number of pieces of luggage, change of the collection or the delivery location, stage postponed) is to be registered before 9:00 am the day before and is accepted by Bagafrance without any extra fee. 

Some extra fee might be requested by Bagafrance if a change is requested after 9:00 am the day before.

If the change request includes the cancellation of a transfer, the cancellation" policy is applied.

1.9. Invoicing Policy

The service payment is made as soon as the booking is validated by both Bagafrance and the customer. Therefore, the transport contract between Bagafrance and the customer is closed only when the payment has been received by Bagafrance, prior to the date of departure.

1.10. Insurance

If lost, stolen or damaged during the transport between collection and delivery (loading and unloading included), every piece of luggage, every bicycle or other kind of package is insured for 23 euros per kilo, up to a maximum of 750 euros per piece. This insurance is included in the price. 

On request, the customer may select an extra insurance by declaring the real value ("ad valorem") of one or several pieces of luggage, bicycles or other kinds of package.

1.11. Reservations Policy

(French Code of Commerce, art. L. 133.3): the customer has 3 full working days after the delivery to send to Bagafrance his reservations regarding the condition of the transported pieces of luggage, bicycles or other kind of packaged belongings described on the contract. Therefore, after the delivery, all the transported pieces of luggage, bicycles or other packaged belongings are to be checked by the customer (number of pieces,  external condition, internal condition)

If there are some reservations, the customer is invited to describe as simply and as accurately as possible what he or she observes. In any case, mentions such as "submitted to additional check" or "submitted to further control" are not valid and will not be accepted by Bagafrance.

If some damage or some lack are not reported to Bagafrance according to the above rules, no reimbursement will be possible.

For any question or more detailed explanation on the above policy, the customer is invited to contact Bagafrance by email or by phone.

1.12.  Disclaimer clause

In addition to the disclaimer clause which is included in the transport contract between the company and the customer, Bagafrance declines responsibility in case of theft or damage before collection or after delivery to the indicated location as described in the contract. 

 

2/ Transport of passengers

2.1. Transport of passengers

Bagafrance transports passengers. This activity meets the standards of the "Public transport of passengers in vehicles equipped with a maximum of 9 seats, driver included". The transport is possible with luggage, bicycles and other packaged goods belonging to the passengers.

2.2. Area of transport of passengers

The area of transport of passengers is the one described in the above paragraph 1.3. The rates depend on the number of kilometers of effective transportation and are given to the customer after a request made by email or by phone.

On request, the transport of passengers is conducted, under specific conditions, between the usual area of operation of Bagafrance and some regional or national train stations and aiports.

2.3. Booking, cancellation and change policy

For the transport of passengers with luggage (and bicycles if needed), Bagafrance operates only when the transport is booked at least 72 hours prior to the departure (i.e. before 9:00 am three days before the transport).

This booking must be registered by email at reservation@bagafrance.com or by phone. The transport is accepted by Bagafrance, depending on the availability of the vehicles, but might be unfortunately refused if the vehicles are not any more available on the day of transportation. The transport booking is validated and closed as soon as the customer receives a confirmation for the transport and Bagafrance receives the payment in advance.

Any request for cancellation must be received by Bagafrance by email or by phone at least 72 hours prior to the transport departure time. If so, the amount already paid for the transport is fully reimbursed. If the request for cancellation is received less than 72 hours prior to the transport departure time, the amount already paid for the transport is unfortunately not reimbursed.

Any request for change of the transport (different number of passengers or of bicycles, change of location of departure or of arrival, postponing) may be registered without any extra fee, except if the vehicles of Bagafrance are not available regarding the new request. If the transport is no more possible because of the lack of availability of the Bagafrance's vehicles, the change is considered as a cancellation and is reimbursed only if the change has been requested more than 72 hours prior to the planned departure time. If not, the transport is not reimbursed.

2.4. Insurance

Bagafrance has an insurance for the transported passengers and their luggage, bicycles and other packaged goods. The hand luggage remain under the responsibility of the passengers during the transport and are not insured by Bagafrance. This insurance is included in the price for the transport.

2.5. Reservations 

(French Code of Commerce, art. L. 133.3): the customer has 3 full working days after the arrival to send to Bagafrance his reservations regarding the condition of the transported pieces of luggage, bicycles or other kind of packaged belongings, except for the hand luggage. Therefore, after the arrival, all the transported pieces of luggage, bicycles or other packaged belongings are to be checked by the customer (number of pieces,  external condition, internal condition)

If there are some reservations, the customer is invited to describe as simply and as accurately as possible what he or she observes. In any case, mentions such as "submitted to additional check" or "submitted to further control" are not valid and will not be accepted by Bagafrance.

If some damage or some lack are not reported to Bagafrance according to the above rules, no reimbursement will be possible.
